These Terms and Conditions (“Terms”) govern your participation in the EvoCare Token Presale (“Presale”) organized by EvoCare Holding AG (“Company”, “we”, “our”).
By accessing the Presale Dashboard or purchasing EvoCare Tokens (“EVOCARE”), you agree to these Terms in full.

1. Eligibility

1.1 Participation is limited to individuals who are at least 18 years old and legally permitted to engage in token sales in their jurisdiction.
1.2 Residents, citizens, or entities from restricted jurisdictions (including, but not limited to, the United States, Canada, China, and countries under international sanctions) are not allowed to participate.
1.3 By participating, you confirm that you are not acting on behalf of a restricted person or entity.

2. Nature of the Token

2.1 The EVOCARE Token is a utility token. It is designed for use within the EvoCare ecosystem (rewards, staking, governance).
2.2 EVOCARE is not a security, share, or financial instrument and does not grant ownership rights, profit participation, dividends, or voting rights in the Company.
2.3 The purchase of EVOCARE tokens should not be considered an investment in financial instruments or securities.

3. Accepted Payment Methods

3.1 You may purchase EVOCARE tokens using the following payment methods:

  • BNB (BEP20)

  • ETH (ERC20)

  • SOL (Solana)

  • USDC (Multi-chain)

  • BTC

  • Bank Transfer (SEPA/International)

  • PayPal

3.2 All transactions are final and non-refundable. Please ensure you follow the instructions in the Presale Dashboard carefully.
3.3 The Company is not responsible for contributions sent to the wrong wallet address or with incorrect transaction parameters.

4. Token Allocation & Claiming

4.1 Upon successful payment, your purchased tokens will be displayed in the Presale Dashboard.
4.2 Tokens will only be claimable after the Presale ends and the Token Generation Event (TGE) is completed.
4.3 The Company reserves the right to adjust the claiming timeline in case of technical or regulatory reasons.

5. Risks & Disclaimers

5.1 Purchasing tokens involves significant financial risk, including the possible loss of your entire contribution.
5.2 The Company does not guarantee:

  • any future value of EVOCARE tokens,

  • listings on cryptocurrency exchanges,

  • or the profitability of holding EVOCARE tokens.

5.3 The token economy may be subject to changes due to market, legal, or technical factors.
5.4 You acknowledge and accept these risks before making a purchase.

6. Data Protection & Privacy

6.1 We collect only the minimum required personal data to process fiat payments (Bank Transfer, PayPal).
6.2 All personal data is processed in accordance with EU GDPR regulations.

7. Limitation of Liability

7.1 To the maximum extent permitted by law, EvoCare Holding AG and its affiliates shall not be liable for:

  • loss of funds, profits, or revenue,

  • technical failures of blockchain networks,

  • unauthorized access to your wallet or account.

7.2 You are solely responsible for securing your private keys and wallet access.

8. Governing Law & Dispute Resolution

8.1 These Terms shall be governed by the laws of Germany, without regard to conflict of law principles.
8.2 Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in Nuremberg, Germany.

9. Amendments

9.1 The Company may update or modify these Terms at any time.
9.2 Updated Terms will be published on the official EvoCare Presale website (https://ico.evocare.de).
